Terms and Conditions


§1 General Provisions

These are terms and conditions on which we agree to supply products to you.  Please read these carefully before you submit your order to us.  These terms tell you who we are, how we provide products to you, what to do if there is a problem and other important information.


Who we are

1.1. We are SJ Car Parts a sole trader established in England and Wales. Our registered VAT number is GB 244321437 (“we”; “us”).

1.2. We are available at: www.sjcarparts.com (“Website”).


The status of these terms and conditions

1.3. Terms and Conditions state a) Conditions of using our Website to order, accepting and processing the orders (§2); b) Terms of Data Protection (§3); c) Terms of warranties, complaints procedure and returns (§4); d) Our responsibility (§5); e) Final resolutions (§6).

1.4. We reserve the right to change the prices of our products displayed on our Website (“Products”) and the content of these terms and conditions. Information about any changes to these Terms and Conditions will be posted on our Website. 

 

§2  Conditions of using our Website to order, accepting and processing the orders

2.1. By purchasing a Product through our Website you confirm you have read and accepted these Terms and Conditions.

2.2. You can only place an order (“Order”) for our Products after registering with us on our Website, which involves filling out a form (“Form”) where you must provide an address and phone number – this personal information will not be passed on to a third party. (Please see the section below entitled Data Protection). You can also place an Order by sending an e-mail to us at: info@sjcarparts.com

2.3. We will only fulfil your Order and send your purchased Product after you have completed a Form and after we have received full and correct payment into our account in cleared funds (“Funds”).

2.4. Terms and times of accepting and fulfilling the orders:

a) You can place an Order on our Website at any time.

b) Our acceptance of your Order will take place when we email you to accept it, at which point a contract will come into existence between you and us.

c) If we are unable to accept your Order, we will inform you of this and will not change you for the Product(s).  This might be because the Product is out od stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the Product or we are unable to meet a delivery deadline you have specified.

d) we will assign an order number to your Order and tell you what it is when we accept your Order.  It will help us if you can tell us the order number whenever you contact us about your Order.

e) Order's dispatch time: subject to our acceptance of your Order and receiving the Funds, we will  dispatch the Products set out in the Form within 24 working hours (“Dispatch time”).

f) Delivery time: delivery time is the period from us sending the Product via royal mail or by means of another courier, until you receive it. More information on couriers and the estimated time of delivery can be found in “Dispatch” on our Website. 

g) Dispatch not on time: the Dispatch Time may be delayed or extended where there are circumstances outside our control. In such a case you will be notified of the delay.  

h) Couriers: delivery of Products to you is made by using the following courier companies: DPD, UPS, DHL, UK Mail, iPost or Royal Mail. More detailed information on delivery of Products is set out in the respective courier’s terms and conditions. We do not accept any responsibility for deliveries made by courier.  Any complaints in regards to such a delivery must be made to the respective courier company. In some cases we may offer to help during the complaint procedure in regards to undelivered items.

i) Unpaid Orders which are older than 7 days will be cancelled and we are under no obligation to fulfil such Orders.

2.5. Cancellations and changes of orders:

You can make changes to your Order up until the Product(s) is dispatched by courier. You can withdraw an Order, unless the Product(s) has already been passed to the courier. Cancellation after the Product(s) has been shipped is regulated by the cool off period. If you wish to make changes to your Order then please contact us at: info@sjcarparts.com

2.6. Availability of stock:

a) Products displayed on our Website should be available to you. If this is not the case and you place an Order then we inform you about the status of your Order and when, and if, your Order will be dispatched.  You can then decide whether to go ahead or cancel part of your Order.

b) If you have ordered one Product and it is subject to clause (a) above then we will notify you by e-mail and you will have the option to proceed with, or cancel, your Order.

2.7. Promotions:

a) Our Website may offer seasonal promotions or sales on selected Products. These promotional offers are made subject to the availability of such Products.

2.8. Payments:

b) All prices include Vale Added Tax (“VAT”) which is set at 20% or such other percentage applicable from time to time. Our default currency is Pound Sterling, but you can change the currency by pressing “Currency” on our Website. Currencies are calculated according to the guidelines set out at http://www.xe.com/

c) Subject to any variation set out in these Terms and Conditions, Product prices set out on our Website are final and binding.

d) We will raise a VAT invoice on each Order and send this with the Product you have ordered.

e) We offer the following payment types: - on-line payment via PayPal – this payment is instant; - Bank Transfer to our account – this payment takes 1-3 working days to clear; payment via voucher or a promotional coupon.


§3 Data Protection

3.1. We will hold your personal data which you provide during the registration process and as and when required by us.

3.2. We will keep your personal data confidential and will not transfer it to a third party. All personal data will be processed in accordance with the requirements of the General Data Protection Regulation (GDPR) (EU) 2016/679.

3.3. You can change any personal data at any time by going to the “My Account” section on our Website.

3.4. If you elected, during the registration, to receive our newsletter then we will e-mail you seasonal information about our Products and offers. You can unsubscribe from the newsletter in the “My Account” section on our Website.

§4 Warranty, complaints and returns

4.1. Warranty

a) We provide a 3 months warranty on every electronic and mechanical Product we sell to you. This warranty does not include decoration or gadget Products. 

b) In case of a faulty Product, not caused by you, we may exchange such Product by way of satisfaction of the warranty.

4.2. We hope you will be satisfied with our Products.  If not then you can make a complaint via a link on our Website.

4.3. You should provide an explanation of the defect detected in the Product you ordered as part of your complaint. You will need to confirm that you placed an Order with us in order to deal with your complaint. You will need to provide your order number or invoice number.

4.4. The maximum amount of our liability will be 100% of the Product price.

4.5. We may ask you to return the faulty Product or prove there is a defect.

4.6. Complaints deadline:

- A complaint can be made up to 10 days from the delivery of the Product to you. (There is an exception for products with 3 months warranty). We have the discretion to look into a complaint received after this deadline.

4.7. We will aim to acknowledge your complaint within 24 working hours of receipt by us.  We will have 14 days after that to look into your complaint.

4.8. In the case of a complaint accepted by us, we undertake to exchange the faulty Product for another similar Product or to refund the value of that Product in accordance with 4.4 above. We will send you a replacement item at our expense.

4.9. Our complaints procedure does not cover a situation whereby a Product has not been assembled correctly, in case of an accident, normal wear and tear or early consumption because of the bad condition of other elements linked to the Product.

4.10. if the delivered Product is not as you ordered, you will let us know as soon as possible. We will exchange the Product, subject to availability, with the correct Product at our cost. If a replacement Product is not available then we reserve the right to refund you the cost you paid us for that Product. 

4.11. Terms for making a complaint in relation to a delivered Product subject to an Order:

a) In case of any visual damages to the Product or any missing part- you will have to raise a loss claim with the courier, otherwise you may not have a right to make a complaint to us. To make a complaint for inappropriate shipment then you must raise a complaint within 7 days of you receiving the Product. In case of a damaged Product, you must take photographic evidence of the damage. A complaint made after 7 days of receiving the Product may be investigated by us at our discretion.

b) If you refuse to accept the Product, it will be returned to us at your cost.

4.12. Return of items:

You can return a Product if the following conditions are met:

a) Up to 30 days of the Order date;

b) The returned Product must be unused and undamaged;

c) The product is not a decoration or gadget Product.

d) You do not need to explain the reason for the return.

e) In this case we will refund you the cost you paid for the Product but not the postage price.

f) You must pay the postage cost of returning the Product.

g) Refunds will be made within 7 days from us receiving the Product.

4.13 If you are ending a contract for a reason set out at (a) to (e) below the contract will end immediately and we will refund you in full for any Products which have not been provided and you may also be entitled to compensation.  The reasons are:

a) we have told you about an upcoming change to the Product or these Terms of Business which you do not agree to;

b) we have told you about an error in the price or description of the Product you have ordered and you do not wish to proceed;

c) there is a risk that the supply of the Products may be significantly delayed because of events outside our control;

d) we have suspended supply of the Products for technical reasons, or notify you we are going to suspend them for technical reasons, in each case for a period of more than 30 days.

e) you have a legal right to end the contract because of something we have done wrong.

4.14 For most products bought online you have a legal right to change your mind within 14 days and receive a refund.  These rights are set out in the Consumer Contracts Regulations 2013.

4.15 If you end the contract for any reason after the Products have been dispatched to you or you have received them, you must return them to us, You must post them back to is at our address or (if they are not suitable for posting) allow us to collect them from you. Please email us for a return label or to arrange collection.  If you are exercising your right to change your mind you must send off the goods within 14 days of telling us you wish to end the contract.

4.16 If you are responsible for the costs of return and we are collecting the Product from you, we will charge you for the direct cost to us of collection.

4.17 If you are exercising your right to change your mind:

a) we may reduce your refund of the price (excluding delivery costs) to reflect any reduction in the value of the Product, if this has been caused by your handling of them in a way which would not be permitted in a shop.  If we refund you the price paid before we are able to inspect the Product and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount

b) the maximum refund for delivery costs will be the costs if delivery by the least expensive delivery method we offer.  For example if we offer delivery of a Product within 3-5 days at one cost but you choose to have the product delivered within 24 hours at a higher cots, then we will only refund what you would have paid for the cheaper delivery option.

4.18 We may end the contract for a Product at any time by writing to you of:

a) you do not make payment to us when it is due and you still do not make payment within 7 days of us reminding you that payment is due;

b) you do not, within a reasonable time for us asking for it, provide us with information that is necessary for us to provide the Products; and

c) you do not, within a reasonable time, allow us to deliver the Products to you.

4.19 If we end the contract in the situation set out in (b) above we will refund any money you have paid in advance for Products we have not provided but we will deduct or charge you reasonable compensation for the net costs we will incur as a result of you breaking the contact.


§5 Our responsibility

5.1. We will not be liable for:

a) Delays on deliveries of Products by any outside courier companies;

b) Promptness of transferring money between your account and PayPal;

c) The quality of the Product delivered via Royal Mail or courier. Complaints in regards of the quality (packaging, incomplete packages) will only be considered after providing documents describing the fault (see point 4.11above);

d) Damages as a result of not abiding with these Terms and Conditions;

e) Damages as a result of providing any false or incomplete personal information while ordering Products;

5.2 If we fail to comply with these Terms and Conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failure to use reasonable skill and care.  Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract is made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.

5.3 We do not exclude or limit in any way our liability to you where it would be unlawful to do so.  This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the Products including the right to receive products which are as described and match information we provided to you and any sample or model seen or examined by you; of satisfactory quality; fit for any particular purpose made known to us; and for defective products under the Consumer Protection Act 1987.

5.4 We only supply the Products for domestic and private use.  If you use the Products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.


§6 Final Resolutions

6.1. The images of the Products on our Website are for illustrative purposes only.  Although we have made every effort to display the colours accurately, we cannot guarantee that a device’s display of the colours accurately reflects the colour of the Products.  Your Product may vary slightly from those images.

6.2. The packaging of the Product may vary from that shown in images on our Website.

6.3. We may transfer our rights and obligations under these Terms and Conditions to another organisation. We will always tell you in writing of this happens and well ensure that the transfer will not affect your rights under the contract.

6.4. This contract is between you and us. No other person shall have any rights to enforce any of its terms.

6.5. Each of the paragraphs of these Terms and Conditions operates separately.  IF any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

6.6. If we do not insist immediately that you do anything you are required to do under these Terms and Conditions, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent s taking steps against you at a later date.

6.7. These Terms and Conditions (including any non-contractual disputes or claims) are governed by and construed in accordance with English law and you consent to the exclusive jurisdiction of the English and Welsh courts in all matters (including non-contractual claims or disputes) regarding it.
